Good day. I'm Carlo Art Ian Bautista Toledo and I had my BIR form 2316 processed by my previous agency. Can I ask at my nearest branch a photocopy, or maybe a CTC? I'm really in a rush, and my agency can't provide it asap. Hoping for a positive response. Thanks

Dear Mr. Toledo:

I refer to my letter of Aug 16, 2023 10:12:19 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for another copy of BIR form 2316..

In reply, please be informed that the Revenue District Office (RDO) where your employer/agency is registered can only provide you a copy of your BIR Form No. 2316 for Calendar Year 2022 if your employer/agency has filed in your behalf. They will also be requiring you to present a copy of the duly received Annex F which can be obtained from your employer in which your name is included in the List of Employees Qualified Under Substituted Filing.

For BIR Form No. 2316 for CY 2023, the RDO gets a hold of the said form upon submission of your employer to them on or before February 28, 2024.

Any request for certification that may be requested by a taxpayer from the RDO on matters relating to its registration shall be charged with a fee in an amount not exceeding one hundred pesos (P100.00), in addition to the documentary stamp tax of Thirty Pesos (P30.00) imposed under Section 188 of the National Internal Revenue Code, as amended.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 09, 2023 03:55:56 AM, your request will be closed.
