Dear Mr. Zubiaga,
I refer to my letter of Oct 15, 2022 12:13:39 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316 Document from my Previous Employer.
Kindly provide us the following data in order for us to evaluate your requested information:
1. Your Tax Identification Number (TIN);
2. Name of your Employer (For Calendar Year 2018);
3. TIN of your Employer; and
4. Address of your Employer.
You can also ask from your former employer copy of the duly received Annex F (Proof that your employer came to Revenue District Office) received or duly stamped by the BIR District Office in which your name is included in the transmittal.
On the other hand, you may also ask your previous employer for the copy of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) for the said period because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
