Dear Ms. Pelaez,
I refer to my letter of Sept. 29, 2021, 08:07:34 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR or 2316.
In order for us to work further on your request, in particular, it would be helpful to know exactly what you want, is it ITR or BIR form 2316?
To work further on your request, we need more information from you regarding your query. Kindly provide us the following details and email them at ana.marie.du@bir.gov.ph. as this contains sensitive information
-What ITR did you file in 2020? Was it 1700 or 1701?
-Where did you file your ITR, what RDO are you registered with?
-Your TIN (if self-employed)
-If employed, please indicate your employer’s TIN, RDO no., business name & address
-Tax Return Confirmation Receipt (if your ITR were filed online)
Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file.
Furthermore, if you have been employed and your income tax has been correctly withheld, has only one employer, and has been qualified for substituted filing for the taxable year 2020, the Certificate of Withholding filed by your employer, duly stamped "Received" by the Bureau, shall be tantamount to the filing of the income tax return. You may request Form 2316 from your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, if employment is terminated, on the day on which the last payment of compensation is made.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec. 22, 2021 06:13:38 AM, your request will be closed.

Good morning..Ma'am regarding my request po BIR Form No.2316 Certificate of Compensation Payment/Tax Withheld dated January-December 2020 po ang kelangan ko sorry for confusion..Nag issue na po ang company namin last year kaya lang po namisplaced qo po ung BIR form..my TIN NO. is 240-103-255..my company name is IBIDEN PHILIPPINES INC..FPIP BRGY STA. Dear Ms. Pelaez,
Thank you for your request dated Sep 29, 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR or 2316.
Your requested for the BIR 2316 form for CY 2020.
In reply, it is the obligation of the employer and not the BIR to provide your BIR Form No. 2316 on before January 31 of the succeeding calendar year or if employment is terminated before the close of such calendar year, on the day on which last payment of compensation is made. Pursuant to our Tax Code, non - issuance of BIR Form No. 2316 is subject to mandatory audit by the concerned Revenue Office District. Just provide a written letter of complaint addressed to the concerned Revenue District Officer (RDO) of your employer, if warranted.
