Dear Sir/Madam,

Good Morning!

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting  LOB  GSIS application.

It would be very much appreciated if you can send me a copy via email since I'm out of the country as OFW.

Dear Ms. Cordero:

I refer to my letter of Jan 20, 2023 06:23:36 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In reply, we refer you to Section 6 of Revenue Regulations (RR) 10-2008 and Section 12 of RR 11-2018 wherein EMPLOYERS are required to furnish every employee from whose compensation taxes have been withheld BIR Form 2316 or Certificate of Compensation Payment/Tax Withheld on or before January 31 of the succeeding year or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made. 

Moreover, if you are requesting for a copy of BIR Form 2316 for a particular calendar year, your EMPLOYER during that period (2022 being our recent ITR/BIR Form 2316 and NOT 2023) is the one responsible for issuing the same to you. 

Otherwise, you may try to request a copy from the Revenue District Office (RDO) where your employer is registered, remits taxes withheld and submits reports.

Furthermore, for requests made through a representative, a special power of attorney (SPA), copy of your government-issued ID and original government-issued ID of the representative are required.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 17, 2023 02:55:40 AM, your request will be closed.
