Dear Mr.Canapi,

I refer to my letter of Dec 07, 2021 12:23:59 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return.

In order for us to properly endorse and work further on your request,  kindly provide us the following details and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information.:

-What ITR form did you file for 2020
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file.

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

On the other hand, if you need this requirement for employment purposes, you may just directly request the BIR Form 2316 from your previous employer as your new employer will take into consideration your income from your previous employment for them to do the year-end adjustment and your tax liability will be based on your total income for the year. 

It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 02, 2022 03:43:44 AM, your request will be closed.
