Dear Mr. Morales:

I refer to my letter of Sep 23, 2023 10:25:08 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316 and 1905.

In reply, please be informed of the following:

1.) BIR Form No. 2316 - is a form issued by your employer (A Certificate). Hence, you may request for the re-issuance of the said documents to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.

With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer. 

While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer is registered would take longer to provide you the information you have requested. They have to verify if your employer has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

2.) BIR Form No. 1905 - please be informed that the said form was submitted to the RDO where your TIN is registered or where you are registered. It was submitted in three (3) original copies for stamping “Received”:

> 1st copy – to be forwarded to new RDO by old RDO, attached to Transfer Related  Docket (TRD)
> 2nd copy – old RDO’s file copy;
> 3rd copy – taxpayer’s file copy.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 18, 2023 02:20:33 AM, your request will be closed.
