Dear Mr. Bobias:

I refer to my letter of Jan 25, 2024 10:51:07 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax  Return request.

This is in connection with your request for information, with reference number #BIR-#BIR-721164304346, for the Request for a Copy of your Income Tax Return and/or BIR Form No. 2316.

In reply, upon verification from our BIR System you are registered as Local Employee, thus, you are to coordinate with your EMPLOYER as the same is Mandated to Issue the BIR Form No. 2316 for the Calendar Year (s) 2022 to 2023 (Not 2024), pursuant to Section 83 of the 1997 Tax Code and Section 2 [2.83.1] of Revenue Regulations (RR) No. 3-2002, respectively. 

The EMPLOYER shall furnish each Employee/s with the Original Copies of BIR Form No. 2316 as Proof that your Taxes were Withheld and this will serve as your Income Tax Return (ITR).  EMPLOYER is required to issue BIR Form No. 2316 on or before January 31 of Every Year and On the Day the Last Payment of Compensation is Paid.
