Good day! am writing to request a verified copy of my BIR form 2316 & 1701 for the years 2013-2018 for the purpose of presenting Financial Evidence for my application for Trade Recognition Australia's Skills Assessment.
I have already contacted rdo 39 and I am looking for further assistance regarding this matter to see to it that I will be able acquire the requested documents. I

Dear Ms. Raagas,
I refer to my letter of Dec 20, 2021 09:32:48 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR form 2316 & 1701.
In order for us to properly endorse and work further on your request, kindly clarify what exactly do you want to request (2316 or 1701) and provide us with the following details (for each year beginning 2013 onwards and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information
-What ITR did you file?
-Where did you file your ITR, what RDO are you registered with?
-Your TIN (if self-employed)
-Tax Return Confirmation Receipt (if your ITR were filed online)
If employed, your employer's name and business address and TIN No.
Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. Furthermore, please be informed of the below procedure in ITR Filing prior to 2013:
1. The employers provide for the BIR Form 2316 to their employees after the year ends; and
2. Subsequently, all employees are required to file their returns to the RDOs where they are registered, with tax due or zero/no payment, hence we cannot provide a copy of BIR 2316.
The mandatory submission of Employees’ BIR Form 2316 in lieu of the Income Tax Return (ITR), “who are qualified for substituted filing” by the employers started the year 2013, reference-based in RR No. 11-2013 and further amended by RR 2-2015.
However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 14, 2022 01:53:27 AM, your request will be closed.
