Dear Ms. Andal:

Greetings!

Thank you for your request dated Oct 11, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Requesting Income Tax Return and/or BIR Form No. 2316.

Response to your request

In reply, please be informed that your request has been denied due to the following:

1. Kindly attach scanned copies of at least two (2) valid government issued I.D.s; and
2. If you are employed for the Calendar Years 2022 to 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for aforesaid years  pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer  if you have not receive a copy of your BIR Form 2316 for Calendar Years 2022 to CY 2023 (in case your employment with the company has been terminated/ended before the end of this year).
