Hi, I would like to request for my ITRs for the years 2016-2019. I would need it as a proof that I was employed during those years.

Dear Mr. Balanay:

I refer to my letter of Mar 01, 2023 09:34:14 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form 2316.

In reply, please be informed that your request for a copies of your BIR Form 2316 for Taxable Years 2016 to 2018 cannot be granted by the Revenue District Office (RDO) since the aforesaid BIR Withholding Tax Certificates were issued in 2016 to 2018 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

On your other request, for a copy of your BIR Form 2316 for Taxable Year 2019, kindly provide us the following information:

1. Complete Name and Address of your Employer; and
2. TIN Number of your Employer, for us to coordinate and endorse to the RDO where your employer is registered.

Email the needed information at sherry.ann.arcita@bir.gov.ph and indicate in the email subject ticket number #BIR-752183876358, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 25, 2023 03:46:31 AM, your request will be closed.

Dear Jezy Verence Balanay,

Greetings!

Thank you for your request dated Mar 01, 2023 09:34:14 PM please be informed that copies of the document must be secured by the issuing party. 

In your case, BIR Forms 2316 are issued by an employer to its employees. Moreover, the said document is made in triplicate copies. Original copy is given to the employee and said document is duly signed both by the employer and employee. The employer also prepares the list of the employees together with the copy/ies of the said BIR Form/s 2316 as proof that said document is duly submitted to the Bureau.

In connection thereto the proof of submission by the employer is a requirement before you secure the document from our end. And since the said proof is to be secured from your employer, it is advised that instead of requesting proof of submission, you may then secure copy of the BIR Form 2316 directly from them, being the issuing party. 

Moreover the document requested contains the signature of the parties concerened, providing you of the documents may violate the Data Privacy Act.

While our aim is to provide information whenever possible, we could not give at this instance your requested document as explained on the preceding paragraphs. However, you may wish to contact RDO 040, Cubao, whom your employer is registered at 8863-4077.
