Dear Sir/Madam,

Hope you are doing well.

I am requesting and hopefully receive a copy of my BIR 2316 form. The purpose is I need to submit it to my new employer because my previous employer cannot provide my 2316 due to various reasons. I worked from March 2022 to April 2023.


It would be very much appreciated if you can send me a copy via email as my employment is on the line — I have to submit this on or before October 20, 2023

Dear Mr. Villalon:

I refer to my letter of Oct 05, 2023 04:30:24 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request of my BIR 2316.

In reply, BIR Form No. 2316 is a form issued by your employer (A Certificate). Hence, you may request for the issuance of the said documents to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.

With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer. 

While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer is registered would take longer to provide you the information you have requested. They have to verify if your employer has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 29, 2023 03:23:56 AM, your request will be closed.

I have a pending balance to my employer because its a immediate resignation. I need to pay it first before I get my BIR 2316 and other documents needed. Right now, due to trying times I'm not capable to pay them right away to get my documents that I need to pass to my new employer. Is there any other options so I can get my BIR 2316? Thank you so much for your help.
