Dear Ms. LUARCA,

I refer to my letter of Mar 15, 2022 12:40:13 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR 2316.

In order for us to properly endorse and work further on your request, we need more information from you regarding your query. Kindly provide us with the following details (from 2012-2020) and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information
-What ITR form did you file? 
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. Furthermore, ITR for 2021 is yet to be filed on or before April 15 this year.

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jun 07, 2022 07:20:14 AM, your request will be closed.

Greetings!

Thank you for your request dated Mar 15, 2022 12:40:13 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for ITR 2316.

Response to Request

After careful consideration, we resolve to grant your request but only up to the compensation and withholding tax information found in the Alphalist of Employees filed by your employer under our jurisdiction for the years 2012 to 2015.  A certification was made on the information gathered for your purpose, a scanned copy of which was sent thru the email provided.

Based on the reason stated below, we resolve to deny your request as to the following information:   Copy of your ITR for the period.

This Office does not have the information you have requested (ITR) since it was only starting 2015 when the employers were required to furnish the BIR with scanned copies of BIR Form No. 2316.  Your employer was not required to submit copies of 2316 certificates during the period requested. 

For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
