Dear Sir/Ma’am;

Good day! I am writing to you in hopes of getting a copy of my BIR Form 2316 in compliance to the requirements of my new employer. I tried reaching out to my previous employer but they were not very responsive to me and my new employer needs it already.

Dear Mr. Toring:

I refer to my letter of Jan 17, 2023 04:40:39 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for a copy of your BIR Form No. 2316 for Taxable Years 2020 to 2022.

Kindly provide us the following data in order for us to evaluate your requested information:

1. Your Tax Identification Number (TIN);
2. Name of your Employer/s (For Taxable Year/s 2020 to 2021);
3. TIN of your Employer/s; 
4. Address of your Employer/s.

Email the requested information at sherry.ann.arcita@bir.gov.ph as this contain sensitive information. Indicate in the subject email ticket number #BIR-764261395861, to respond.

On your other request for a copy of your BIR Form No. 2316 for Taxable Year 2022, the RDO gets a hold of the said BIR Form 2316 upon submission of your employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2023. The same shall be issued to you by your Employer on or before January 31, 2023.

However, you may wish to contact/coordinate with your employer for a copy of your BIR Form No. 2316 for the year 2022 in case your employment with them is terminated before the close of the calendar year and on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 12, 2023 03:54:41 AM, your request will be closed.
