Hi. May I request for the copies of my BIR form 2316 for the years 2010-2014. If the forms are not available, I would like to request for a certificate of compensation and withholding tax information which can be found in the Alphalist of Employees filed by my employer for the mentioned years. Dear Ms. Ramos,
I refer to my letter of Aug 04, 2021, 10:49:16 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for a Request copy of BIR form 2316.
Please be informed that prior to 2013,the mandatory submission of Employees’ BIR Form 2316 in lieu of the Income Tax Return (ITR), “who are qualified for substituted filing” by the employers started the year 2013, reference-based in RR No. 11-2013 and further amended by RR 2-2015, hence, we cannot provide you a copy of your 2316 from 2010-2012.
However, in order for us to work further on your request, we need more information from you regarding your query. Kindly provide us the following details:
- What ITR did you file from 2013-2014? Was it 1700 or 1701?
- May we know where you filed your ITR, what RDO are you registered with?
- Your TIN (if self-employed)
- If employed, please indicate your employer’s TIN, RDO no., business name & address
- Tax Return Confirmation Receipt (if your ITR were filed online)
Also, kindly provide us your contact number, two government-issued IDs and your selfie picture, as proof of your identity and email it at ana.marie.du@bir.gov.ph.
Furthermore, please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. Your BIR Form 2316 should have been issued to you by your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made. This should be filed as an attachment to your ITR.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 27, 2021 12:31:00 PM, your request will be closed.

After the reply of Ms. Ana Marie Du in August 5, 2021, the taxpayer has no response. Aside from almost 1 year and 6 months pending request, the following details are needed to process the request:
