Dear Ms. Robles:

I refer to my letter of Aug 06, 2023 04:46:49 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIF Form No. 2316.


In reply, please be informed that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316. 

BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”

The duty therefore to provide you a copy of your ITR/BIR Form No. 2316 for a taxable year rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year (CY) 2022 (being your most recent issued ITR) and/or BIR Form 2316 for CY 2023 (In case your employment with the company has been terminated).

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 30, 2023 02:46:46 AM, your request will be closed.

Thanks! I already got my BIR 2316 and I'd like to know if I can request a copy of my ITR online. Should I email the person you have provided?

Greetings!

Thank you for your request dated Aug 06, 2023 04:46:49 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Income Tax Return (BIR Form No. 1700) and/or BIR Form No. 2316.

Response to your request

This is in connection with your request for information for a Copy of BIR Form No. 2316.

Please take note that for the year 2022 you are supposed to file your Annual Income Tax Return (AITR) since you have three (3) Employers, using BIR Form No. 1700 through Offline Electronic BIR Forms Package (downloadable at the BIR website, www.bir.gov.ph), attach and consolidate your 2316 received from your three (2) employers within the same taxable year or your payslip for reference.

You may ask for assistance in the filing of your 2022 Income Tax Return at the Revenue District Office (RDO) where you are registered. Upon inquiry with the BIR system, you are registered at RDO No. 49-North Makati. You may call them at telephone nos: 8-8524-0782 and 8-8556-6350.
