Dear Mr. Morales:

I refer to my letter of Sep 05, 2023 04:50:38 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for INCOME TAX RETURN.

In reply, please be informed that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316. 

BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”

The duty therefore to provide you a copy of your ITR/BIR Form No. 2316 for a taxable year rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022.

Dear JOSEPH JERVY D MORALES,

I refer to my letter of Sep 05, 2023 04:50:38 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for INCOME TAX RETURN.

In order for us to work further on your request, we need more information from you regarding your query.  Please be informed that BIR Form 1700 is the income tax return filed by a local employee who did not qualify under the substituted filing (the certificate of tax withheld – BIR Form 2316 issued by the employer serves as the 1700 or Income tax return of the employee). In particular, it would be helpful to know the following details:

1)	What is the Complete name indicated in the Income Tax Return you filed?
2)	What is your Tax Identification Number as indicated in your filed return?
3)	What Revenue District Office No. did you file your form 1700?
4)	Did you file online or over the counter?

Please be informed further that this office does not have copies of the “No Payment” returns filed either through eBIRForms or eFPS.

It is to note further that Income Tax Returns are being filed by the taxpayer himself at the Revenue District Office having jurisdiction over the registration of the said TP and as such, this is not actually issued by the BIR. Details input on the Income tax Return will voluntarily come from the TP.

I refer to my letter of Sep 06, 2023 about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for INCOME TAX RETURN. In particular, I had requested specific information for you to clarify upon in order for us to proceed with the request.

As we have not received a reply within the 60-day working period since the letter requesting for clarification was sent out, we regret to inform you that this request will be closed as of Nov 29, 2023.

You may wish to submit a new request describing the specific information you are looking for, and we will be able to consider it under the guidelines as stated in Executive Order No. 2.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to or visiting our central office. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
