Hi,

Good day! I would like to request for a copy of my latest ITR. I need to know the RDO of my previous company. I'm switching from being an employee to freelancer this year. Thank you!

Dear Ms. Agra:

I refer to my letter of Apr 16, 2023 12:16:44 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Latest Income Tax Return and/or BIR Form 2316.

We called your mobile number today, April 18, to validate your existing eFOI request, however, it was unsuccessful.

if you are an Employee for the period January to December 2022, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2022 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022.

On your other concern, you can now retrieve your Taxpayer Identification Number (TIN) and Revenue District Office (RDO) Code (where your TIN Number is registered) through Revie’s TIN Inquiry Module. Revie can be accessed on the BIR website at https://www.bir.gov.ph.

Once you know your current RDO, they will be the one to transfer your TIN registration to the RDO having jurisdiction over the place of your residence. This is also where you have to request for the change in your taxpayer type from Local employee to Self-Employed Professional.

Thank you.

Respectfully,

FOI Receiving Officer
