May 16, 2022 Dear Mr. Sherwin Tan: Greetings! Thank you for your request dated May 14, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You request for your Income Tax Return (ITR) or BIR Form 2316 from 2018 - 2021. In response to your request, we called your contact information to verify some details, to wit: 1. What ITR are you referring with, is it BIR Form 2316 for Compensation Income Earners (Employees) or BIR Forms 1701 or 1701A for Self-Employed Individuals including Job Order Contract; and 2. That you are Employed under EIS in Quezon City. In this regard, you cannot secure from us a copy of your 2018-2021 BIR Form 2316. However, if you have been qualified for a "Substituted Fling", the BIR Form 2316 which has been issued to you by your employer is as good as your Income Tax Return, If in case 2018-2021 BIR Form No. 2316 (Certificate of Compensation Payment/Tax Withheld) has not been issued to you, demand a copy from your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee if employment is terminated before the close of such calendar year, or on the day on which the last payment of compensation is made.
