I refer to my letter of Jul 26, 2022 10:20:09 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for Income Tax Return (ITR) and/or BIR Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as Substitute  Income Tax Return for Taxable Year/s January 1, 2011 to December 31, 2016, kindly send us the Name of your Employer/s for the covering period/s, Business Address of your Employer/s and Employer/s Taxpayer Identification Number (TIN) and email it at sherry.ann.arcita@bir.gov.ph indicate in the subject tracking number #BIR-783341210606 to respond. We will coordinate and endorse your request to the Revenue District Office (RDO) having jurisdiction over the place of your Employer/s and where they submits their reports.

Please be informed also, that per record/files of the district office/s for the aforementioned years most likely were already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, retention period of withholding tax certificates. It will be practical and appropriate for you to refer to your employer and ask for the said copies where it actually originated.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 19, 2022 02:15:01 AM, your request will be closed.

Greetings!

Thank you for your request dated Jul 26, 2022 10:20:09 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for Request for Income Tax Return (Form 2316).

Response to Request

Based on the reason stated below, we resolve to deny your request as to the following information:   Copy of your ITR for the year 2011-2016.

For the years 2011-2014
This Office does not have the information you have requested (ITR) since it was only starting 2015 when the employers were required to furnish the BIR with scanned copies of BIR Form No. 2316.  Your employer was not required to submit copies of 2316 certificates during the period requested. 

For the year 2015
This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2015.  

For the year 2016
We regret to inform you that your request cannot be processed because your employer failed to submit a CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2016.

After careful consideration, however, since your TIN and name is included in the Alphalist of Employees by your employer for the year 2011-2016, we resolve to grant your request but only up to the compensation and withholding tax information found in the Alphalist of Employees filed by your employer for 2011-2016.  A certification was made on the information gathered for your purpose, a scanned copy of which was sent thru email.

For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
