I refer to my letter of Jul 27, 2022 11:20:36 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as Substitute  Income Tax Return for Taxable Year/s October 22, 2019 to January 25, 2020, kindly send us the Name of your Employer/s for the covering period, Business Address of your Employer/s and Employer/s Taxpayer Identification Number (TIN) to sherry.ann.arcita@bir.gov.ph and indicate the tracking number #BIR-784615127681. We will coordinate and endorse your request to the Revenue District Office (RDO) having jurisdiction over the place of your Employer/s and where they submits their reports.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 20, 2022 01:03:04 AM, your request will be closed.

You asked for Income tax return.

Response to your request

While our aim is to provide information whenever possible, however records from your mentioned employer "Bricolage" revealed that your name Diary Gumawid Cortez does not appear as one of its employees in their 2020 1604C -Alphalist. In view thereof, we regret to inform you that we cannot give due course of action on your request, kindly provide evidences of your employment records in order for us to properly address your request.

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to rdo_45css@bir.gov.ph / rdo_45@bir.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
