BIR requires presentation of certified true copy of deed of sale from national Archives or clerk or court for antedated deed of sale. if both agencies only provided certificates of unavailability of the deed of sale, what other document will be acceptable to process eCAR?

Greetings!

Thank you for your request dated Mar 14, 2022 06:47:03 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your are requesting for legal remedy in case of unavailability of Certified copies of deed of sale.

The question has to be initially addressed to the processing office so you can come up with an acceptable alternative document to prove the existence of a document. The presentation of the original or at least a certified true copy of a deed of sale is indispensable especially since there is a purported transfer of a real property and the owner thereof might be prejudiced should it turned out that the photocopy of the deed of sale is falsified. For further clarification, you may call Law and LEgislative Division at telephone number 8981-7326 to 29 and look for the officer of the day.
