Dear Ms.Estrologo,

I refer to my letter of Jan 05, 2022 04:25:04 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316 Document.

In order for us to properly endorse your request to the concerned office, we need more information from you regarding your query.  Kindly email the TIN, name & business address of your employer at ana.marie.du@bir.gov.ph.

However, if you know where you filed your BIR Form 2316 , you may directly request it to the concerned RDO for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

On the other hand, you may also just directly request the BIR Form 2316 from your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 31, 2022 09:27:52 AM, your request will be closed.
