I would like to request a copy of my BIR FORM 2316 (Certificate of Compensation Payment/Tax Withheld) for the year 2022.

This is because this is one of the requirement needed by my new employer. My last day at my previous employer was September 9, 2022 and my start date at my new employer was last September 12, 2022. I will highly appreciate if you grant my request.

Greetings!

Thank you for your request dated Sep 25, 2022 02:08:22 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for BIR FORM 2316.

Response to Request

We would like to inform you that your request for your BIR form 2316 can’t be processed yet because BIR 2316 Forms for the taxable year 2022 are only to be submitted by your employer to the BIR Revenue District Office (BIR-RDO) on February 28, 2023.

Please be informed that BIR Form 2316 must be accomplished by your employer for each employee receiving salaries, wages, and other forms of remuneration, indicating the total amount paid and the taxes withheld for the calendar year.

It must be issued to the employee on or before Jan. 31 of the succeeding year, or on the day of last payment of wages in case of termination from employment. This certificate, will serve as your ITR being an employee earning purely compensation income regardless of the amount. You are qualified to “Substituted Filing” of ITR pursuant to Revenue Regulation (RR) No. 2-98 as amended.
