Dear Sir/Madam,

Hope you are doing well.

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form from 2014-2017. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not able to provide me with my BIR 2316 form.

It would be very much appreciated if you can send me a copy via email as my employment is on the line — I have to submit this on September 23rd.

Greetings!

Thank you for your request dated Sep 20, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for BIR 2316 form.

Response to your request

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as a Substitute Income Tax Return for Taxable Year/s 2014 to 2017.

Please be informed that per record/files of the district office/s for the aforementioned years on Withholding Tax Certificates (BIR Form 2316) were already sent to archive for storage and records disposition as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, Publishing the full text of the Records Disposition Schedule of the Bureau of Internal Revenue which was approved by the Acting Executive Director of the National Archives of the Philippines (NAP) on June 5, 2008.

It will be practical and appropriate for you to refer to your employer/s and ask for the said copies where it actually originated.
