Dear Olena Dy:

I refer to my letter of Aug 31, 2022 09:42:19 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return (ITR).

We would like to know whether you are a Mixed Income Earner (MIE)/Job Order Contract (JO)/Contract of Service (COS) or an Employee during the taxable year January 01 to August 30, 2022 per your request? 

As MIE/JO/COS, it means that you have other source/s of income other than employment and you are required to file your individual ITR (either BIR Form 1701 or 1701A). However, if your source of income is Purely Compensation from your Employer, you are covered under substituted filing and filing of ITR is not required. Your Employer (for that particular period) are required to furnish every employee from whose compensation taxes have been withheld BIR Form 2316 Certificate of Compensation Payment/Tax Withheld on or before January 31 of the succeeding year or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made as proof that your taxes were withheld. This shall serve as your Income Tax Return (ITR).
