Dear Mr. Navales,

I refer to my letter of Feb 16, 2022 01:26:11 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return.

In order for us to properly endorse and work further on your request, we need more information from you regarding your query. Kindly provide us with the following details (from 2012-2014) and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information
-What ITR form did you file? 
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. 

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 11, 2022 05:38:04 AM, your request will be closed.

Response to your request

While our aim is to provide information whenever possible, in this instance this Office does not have the Income Tax Return (ITR) you requested as discussed to you through Facebook Messenger Chat since you are Locally Employed and there are no ITRs filed in our system as verified in our ITS/IRIS. However, you may wish to contact Ms. Robe Ruferos, Freedom of Information Receiving Officer (FRO) at 082-2857988.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response in writing.
