Dear Mr. de Salit:

I refer to my letter of Jan 06, 2024 11:45:23 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Certificate of Compensation Payment/Tax Withheld.

In reply, please be informed that records/files of BIR Form No. 2316 for the Year (s) 2014 to 2019 were already sent to Archive as it was more than four (4) years of Retention Period per Revenue Memorandum Circular (RMC) No. 73-2008.

Hence, you may ask for a copy/copies of your BIR Form No. 2316 to your previous employer (s), because All Taxpayers are required to preserve their accounting records for the period of ten (10) years in accordance with the RMC No. 29-2019.

The available records of documents at the RDOs are from Calendar Year 2020 and 2022.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 05, 2024 11:20:55 PM, your request will be closed.
