Good Day!

As I understand, RMO No. 26-2011 as amended,  is applicable for death benefits provided by the employer. However, one of the requirements provided by PERAA in claiming benefits is a CTE issued by BIR Regional Office.

May I confirm if RMO No. 26-2011, as amended by RMO No. 36-2011 is applicable for requesting Certificate of Tax Exemption for PERAA death benefit claims. Otherwise, may I inquire what is the applicable legal basis.

You asked for clarification on whether RMO RMO No. 26-2011, as amended by RMO No. 36-2011, is applicable i the processing of the tax exemption of death benefits received from PERAA.

In reply, please be informed that the requirements and procedures set forth under RMO 26-2011, as amended by RMO 36-2011, are applicable with respect to the processing of tax exemption of death benefits received from employers. Please observe the guidelines provided therein when you file the request for the tax exemption.
