Hi I would like to request for copy BIR Operations Memorandum No. 20-2019.
We would like to use as reference the RM Circular no. 143-2019 "Clarifications on Inclusion of Tax Payers as Top Withholding Agents Who are Obliged to Remit the 1% and 2% Creditable Withholding Taxes Pursuant to the Criteria of Revenue Regulation No. 7-2019"  but the OM No. 20-2019 is cited here, and as per BIR San Pablo we need the copy of the OM to verify our concern with regards in withholding tax.

Dear Ms.Celine, Sollorano,

    Please be informed that your request copy of Operations Memorandum cannot be processed. However, about your clarification as withholding agent pursuant to RMC No. 143-2019, which states, that,  
   
     a. National Government agencies, government owned and control corporation, state universities and colleges and local government units are excluded in the identification of Top Withholding Agents (TWA). 

 In relation thereto, you are hereby advice to file a letter to RDO No. 55-East Laguna, requesting delisting in the list of TWA being among the enumeration in item a of RMC No. 143-2019. Such letter will be endorsed to the concerned office for evaluation and approval.
