Hi! I would like to request a copy of my Form 2316 for the year 2018. My employer told me that they do not have a copy anymore and I also lost my copy. I will use it for visa application. Thank you!

Greetings!

Thank you for your request dated Oct 05, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Request for Form 2316 (Lost copy).

Response to your request

In reply, please be informed that copy of BIR Form No. 2316 issued for the Calendar Year 2018 is  already unavailable (per records of the Revenue District Office) since we follow strictly the four (4) year retention period of documents based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, All Taxpayers (including your former employer) are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

According to my previous employer, they don't have a copy of BIR 2316, instead what they have for the 10-year preservation is the alpha list which is confidential. Can you please advise me on what should I do with this matter as this is a very important document in my visa application.
