Hi Sir or Madam,

I, Echina Alegada,want to request my BIR form 2316 from the years 2014-2019. I need it for my PR application here in Canada. I am now residing here in Canada and it’s very hard to get hold of the employers. Also one of the companies I worked at 2014-2016 already closed down. I have a limited amount of time to apply for it so I hope I can get it as soon as possible.

Dear Ms. Alegada:

I refer to my letter of Nov 25, 2022 11:41:17 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return Form or BIR Form 2316 as a Substitute Income Tax Return for Calendar Year/s (CY) 2014-2019.

Please be informed that such request cannot be granted by the Revenue District Office (RDO) since the aforesaid BIR Withholding Tax Certificates were issued in 2014 to 2018, and records of the RDO on those periods are already unavailable since we follow strictly the five (5) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because All Taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

On your other request, kindly provide us the following data in order for us to evaluate your requested information:

1. Your Tax Identification Number (TIN);
2. Name of your Employer (for CY 2019);
3. TIN of your Employer; and
4. Address of your Employer.

Kindly email the needed information at sherry.ann.arcita@bir.gov.ph as this contain sensitive information. Indicate in the email subject ticket number #BIR-836428171937, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 17, 2023 11:47:59 PM, your request will be closed.
