To whom it may concern,

Hope you are doing well.

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not able to find and provide me with my BIR 2316. I worked with them from November 2018 to December 2019.

It would be very much appreciated if you can send me a copy via email as my new employer requires it — I have to submit it by this March.

Dear Mr. Escucha:

I refer to my letter of Feb 17, 2023 11:10:10 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In order for us to work further on your request, we need more information from you regarding your query. Kindly provide us the following information in order to evaluate your requested information:

1. Complete Name of your Employer (For Taxable Year 2019);
2. TIN of your Employer;
3. Complete Address of your Employer; 
4. Your Tax Identification Number; and
5. Your Birthday.

Kindly email the needed information at sherry.ann.arcita@bir.gov.ph and indicate in the subject email ticket number #BIR-837721471456, to respond.

Please be informed, that your request for BIR Form 2316 for Taxable Year 2018 cannot be granted by the Revenue District Office (RDO)/by our Office since the aforesaid BIR Withholding Tax Certificates were issued in 2018 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 12, 2023 04:39:56 AM, your request will be closed.

We hope to hear from you at the soonest possible time.
