Good day, I would like to ask an assistance to acquire a copy of my BIR 2316 as it is requested by my current employer. I did reach out to the former hr of my previous employer but she cannot give it to me since my previous company is already closed. I'm employed from sept 2015 until march 2020.

Dear Mr. Redulla:

I refer to my letter of Jan 30, 2023 02:47:44 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as a Substitute Income Tax Return for Taxable Year/s 2015 to 2020.

Please be informed that your request for a copies of your BIR Form 2316 cannot be granted by the Revenue District Office (RDO) since the aforesaid BIR Withholding Tax Certificates were issued in 2015 to 2018 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

For a copies of your BIR Form 2316 for Taxable Years 2019 to 2020, kindly provide us the following data in order for us to evaluate your requested information:

1. Your Tax Identification Number (TIN);
2. Complete Name of your Employer (For Taxable Years 2019 to 2020);
3. TIN of your Employer; and
4. Address of your Employer

Email the requested information at sherry.ann.arcita@bir.gov.ph and indicate in the subject email ticket number #BIR-849491540222, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 24, 2023 11:00:06 AM, your request will be closed.
