Hi! I would like to request a copy of my BIR income tax record filed for the period of 2018 - 2021. Name is Jorgea Pascual Julian. The purpose of this request is for my Permanent Residency application here in Canada. Hoping to hear from you as soon as possible. Thank you very much!

Madam:

I refer to my letter of Sep 16, 2022 02:22:04 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return from 2018-2021.

In order for us to work further on your request, we need more information from you regarding your query. You have indicated in your request that you require a copy of your Income Tax Return (ITR) for Taxable Year/s 2018 to 2021. For verification and clarification, kindly provide additional information on the following:

1. Did you have a registered business between the period 2018 to 2021? Or were you an individual earning on purely compensation income from the period 2018 to 2021?

2.  If employed, kindly provide the name of your employer/s and registered address of your Employer for the period 2018 to 2021?

3. Withstanding your answer to the first and second query, did you file an ITR for the cited period?

Lastly, if you are an employee for the aforementioned years, please allow me to ask if you receive a copy of the BIR Form 2316 or Certificate of Compensation Payment/Tax Withheld For Compensation Payment With or Without Tax Withheld from your employer/s? If the answer is no, please coordinate with your  employer/s and ask for the copy of said BIR Form from year/s 2018 to 2021.

Please be informed that BIR Form 2316 must be accomplished by an employer for each employee receiving salaries, wages, and other forms of remuneration, indicating the total amount paid and the taxes withheld for the calendar year. It must be issued to the employee on or before Jan. 31 of the succeeding year, or on the day of last payment of wages in case of termination from employment. This certificate, will serve as your ITR being an employee earning purely compensation income regardless of the amount. You are qualified to “Substituted Filing” of ITR pursuant to Revenue Regulation (RR) No. 2-98 as amended.

Hi there!

Thank you for your quick reply, here are my answers to clarify my request:

1. It is for an individual earning purely from compensation income from that period.

2. Golden Arches Development Corp. is the name of the company that I worked at before.

3. ITRs were filed during the said period.

4.  They provided me with those, but I can’t seem to find the documents anymore.

Greetings!

Thank you for your request dated Sep 16, 2022 02:22:04 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request for 2316 was referred to LT Document Processing and Quality Assurance Division which is the responsible office for 2316 file of employees of large taxpayers, which in this case is your employer.

You asked for Income Tax Return from 2018-2021.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Divine Soriano at ltad@bir.gov.ph.
