I refer to my letter of Jun 23, 2021 03:14:14 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2361 FORM (2019 & 2020).
In order for us to work further on your request, we need more information from you regarding your query. Kindly provide us the TIN , complete business name and address of your employer for 2019-2020 and email it at ana.marie.du@birgov.ph for us to be able to properly endorse your request to the concerned Revenue District Office.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 16, 2021 07:03:05 AM, your request will be closed.

You asked for BIR 2361 FORM (2019 & 2020).
Response to Request
Your FOI request is approved. I sent a copy of the information you requested - BIR Form 2316 for the period 2020.
Please note that we were not able to provide the information you have requested for the year 2019.
While our aim is to provide information whenever possible, in this instance, this Office does not have custody of the information you requested due to non-submission during the period of the required scanned copies of BIR Form 2316 in CD by your employer.
Employers are mandated by existing regulations to furnish the BIR with scanned copies of the BIR Form No. 2316. This Office will still have to compel your employer to submit data as required.
For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
