Good afternoon. May I please request for a copy of my BIR 2316 for the period June 2017 to Dec 2017?
I need it to prove my employment under a previous employer. This is a requirement of my prospect employer in the absence of my CoE from 2017. The COE in question was lost to a flood and my employer's records were gone to a fire that broke out in their office. In the absence of COE, 2316 will be accepted. Thank you.

Dear Ms. Lacson,

I refer to my letter of Sept. 28, 2021, 01:52:42 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR form 2316.

Kindly clarify from your new employer if what they are asking from you is the past year as maybe what they were asking from you is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year. However, if they were really requiring you to submit your 2017 Bir Form 2316, kindly indicate your employer’s TIN, RDO no., business name & address for us to properly endorsed your request to the concerned RDO and email at ana.marie.du @bir.gov.ph as these are sensitive information

Furthermore, please be informed that your BIR Form 2316 should have been issued to you by your previous employer, If there is any, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 21, 2021 10:50:24 AM, your request will be closed.
