Hi, can i request my bir 2316 for this year, i have asked this to my previous employer but they said they can only give me 2307. i worked with them from april 2020 to july 2021. WeSupport Inc.

Dear Ms. Arabit,

I refer to my letter of Aug. 03, 2021, 09:28:18 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.

Kindly clarify if you are working as a self-employed professional as apparently, you have no employee-employer relationship with the company you are working for as they were issuing you BIR Form 2307. You may also visit the Revenue District Office where you are registered to know your registration type. 

Furthermore, If you are an employee, please be informed that your BIR Form 2316 should have been issued to you by your previous employer, If there is any, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct. 26, 2021, 10:39:42 AM, your request will be closed.

Hi Ms. Ana,

I requested a 2316 from my previous employer, and they said they can only give 2307, hence i was requesting here for my 2316. Also the reason for my request is my new employer is asking for it.
