Dear Ms. Villacrusis:
I refer to my letter of Sep 14, 2023 08:58:38 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.
In order to identify or locate the requested information, we are seeking for further clarification specifically:
1. Did you have a Registered Business between the period January 1, 2018 to January 1, 2019? Or were you an Individual Earning on Purely Compensation Income from the period January 1, 2018 to January 1, 2019?
2. Withstanding your answer to the first and second query, did you file an ITR for the cited period January 1, 2018 to January 1, 2019?
As an added note/reference, if you are an Employee for the period January 1, 2018 to January 1, 2019, your EMPLOYER is required to issue a copy of your BIR Form 2316 for aforesaid years pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).
Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2018 to 2019.
The Available Records of Documents in the Revenue District Offices (RDOs) are from Calendar Year 2020 to 2022.
