Hi! I am Bianca Sheriz Cruz. May I request a copy of my 2316 Form for the purpose of a requirement of my new employer. They're asking for my last year's, 2021, 2316 Form. I have a record from January 1, 2021 to March 18, 2021, with my past employer, and would like to request as they did not issue yet a copy of my 2316 form for 2021. Thank you!

Greetings!

Thank you for your request dated Jan 11, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for a Certificate of Compensation Payment/Tax Withheld.

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as the said document is yet to be submitted in February. However, you may wish to request a copy of this form from your previous employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made. 
Kindly clarify from your new employer if what they are asking from you is the past years as maybe what they were asking from you is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.
