Dear Mr. IBARDELOZA:

I refer to my letter of May 12, 2023 11:17:33 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for Income Tax Return (Form 2316 ).

We called your mobile number today, May 12 to verify your existing eFOI request and at the same time, we would like to inquire as to why your employer was not able to provide you another copy of your BIR Form 2316, considering that your employer prepare the BIR Form No. 2316 in triplicate, which shall be distributed as follows:

(1)	Original – Employee’s copy;
(2)	Duplicate – BIR’s copy; and
(3)	Triplicate- Employer’s copy which shall be retained for a period of ten (10) years.”

We strongly recommend that your request be obtained through your employer as they are obligated to furnish every employee a copy thereof as a proof of taxes withheld which shall serve as an Annual Income Tax Return of the latter according to Revenue Regulation 2-98, as amended.
