Hi! My employer did not give me BIR Form 2316 after my resignation last 2014. I reached out to them and they said that the document may have already been archived.

Does BIR keep a record of it that I can ask for a copy? Or, if any forms are not available, can I get a statement from BIR indicating my tax payment details for 2012-2014 and stating also the name of my employer?

Dear Ms. Pama,

I refer to my letter of Mar 17, 2022 01:06:18 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for Tax Payment Record.

In order for us to properly endorse and work further on your request, kindly provide us the TIN, RDO and complete name and address of your employer from 2012-2014 and email them at ana.marie.du@bir.gov.ph.

On the other hand, it is also advised that you better ask for a copy of your 2316 directly from your employer as they are the main source of such documents.  It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jun 09, 2022 04:32:25 AM, your request will be closed.
