Dear Mr. De Jesus:

I refer to my letter of Oct 05, 2023 02:01:41 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316 for the last 2 Years.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period August 2021 to August 2023? Or were you an Individual Earning on Purely Compensation Income from the period August 2021 to August 2023?

2. Withstanding your answer to the first and second query, did you file an ITR for the cited period August 2021 to August 2023?

As an added note/reference, if you are an Employee for the period August 2021 to August 2023, your EMPLOYER (s) is/are required to issue a copy of your BIR Form 2316 for aforesaid year pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER (s) shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly coordinate with your employer (s) if you have not receive a copy of your BIR Form 2316 for Calendar Year 2021 to 2023 (in case your employment with the company has been terminated/ended before the end of this year).

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 29, 2023 02:39:20 AM, your request will be closed.
