Certificate of Compensation Payment/Tax Withheld (BIR Form No. 2316)

Requested from BIR by T. Reyes at 01:56 AM on Nov 11, 2021.
Purpose: Pre-employment Requirement
Date of Coverage: 01/13/2020 - 08/27/2021
Tracking no: #BIR-943060865367

Reyes 01:56 AM, Nov 11, 2021

Hi! May I please request for the copy of my Certificate of Compensation Payment/Tax Withheld (BIR Form No. 2316) from year 2021?

I submitted the BIR 2316 that I received from my previous company to my new employer but they are requesting the ITR 2316 (2021) which I believe is the same with the BIR 2316. I'm not sure what are they requesting since its my first time to process this kind file to a new company.

If it helps, I believe my RDO Code is 43.

At the very least, can I please get a formal statement from your office if my previous company have paid tax of years 20-21?

Sincerely,
Teffany

Dear Ms. Reyes,

Greetings!

Thank you for your request dated Nov 11, 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request
You asked for Certificate of Compensation Payment/Tax Withheld (BIR Form No. 2316).

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as your BIR Form for 2021 is yet to be filed next year.

However, you may directly request said form from your previous employer as it is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made. Your new employer will take into consideration your income from a previous employment for them to do the year-end adjustment and your tax liability will be based on your total income for the year.

For your information and guidance.

Respectfully,

Ana Marie Du
FOI Officer
