Hi! Good Day!

I would like to know the timeline for an employer to acquire Certificate of Tax Exemption. I was retrenched and still waiting for my separation pay. As per my employer, they need to secure CTE first before they can release the remainder of my separation pay. It has been months already and no CTE have been submitted as per my employer

Thank you for your request dated Jan 15, 2024 04:17:57 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request:

You inquire on the timeline for the issuance  of a Certificate of Tax Exemption (CTE) for your separation benefits due to retrenchment.

Response to Request:

Please be informed that the issuance of the CTE has been devolved to the BIR Revenue District Office having jurisdiction over your employer. The request together with the complete documentary requirements as set forth under Revenue Memorandum Order No. 66-2016 amending RMO No. 26-2011 must be submitted to the said Office. Copies of said RMOs are available at our BIR website under the heading revenue issuances.  Please coordinate directly with your employer and the concerned BIR Office to facilitate your request.
