I refer to my letter of Apr 27, 2023 10:51:07 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form 2316.

In order for us to work further on your request, we need more information from you regarding your query. Relative to this, kindly provide the following;

1. Name of Employer/s for Calendar Year/s 2019 to 2021;
2. TIN of Employer/s;
3. Registered Address of your Employer/s;
4. Your Birthday;
5. Your Address;
6. Your TIN; and
7. Your contact number (mobile no.) in case we need to call you for further information.

Kindly email the requested information at sherry.ann.arcita@bir.gov.ph and indicate in the subject email #BIR-964701435171, to respond.

For BIR Form 2318 for Calendar Year 2018 - cannot be granted/provided to you  by the Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jul 21, 2023 03:14:29 AM, your request will be closed.

Thank you for your request dated Apr 27, 2023 10:51:07 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for ITR Form 2316 for Taxable Year 2018-2021.

Response to Request

Your FOI request is approved. I enclose a copy of some of the information you requested (2316 for Taxable Year 2019).

Please note that we are only able to provide one of the information you have requested due to some reason. Upon verification on our records, COMM TREND CONSTRUCTION CORPORATION (Employer) does not submit the BIR Form 2316 of its’ employees qualified for substituted filing for Taxable Year 2018. In addition, for Taxable Year 2020 and 2021, though the company duly submitted its’ employees ITR, Mr. Dan Jefferson Arciaga is not included on the list of submitted 2316. 

Your right to request a review
