Dear Michael Rodelas:
I refer to my letter of Jul 05, 2022 02:16:35 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR (2316).
In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as Substitute Income Tax Return for Taxable Year/s April 1, 2009 to April 02, 2018, kindly send us the Name of your Employer/s for the covering periods, Business Address of your Employer/s and Employer/s Taxpayer Identification Number (TIN). We will try to coordinate and endorse your request to the Revenue District Office (RDO) having jurisdiction over the place of your Employer/s and where they submits their reports.
Please be informed also, that per record/files of the district office/s for the aforementioned years most likely were already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular No. 73-2008 (retention period of withholding tax certificates) it will be practical and appropriate for you to refer to your employer and ask for the said copies where it actually originated.
Email the needed information at sherry.ann.arcita@bir.gov.ph. Please indicate in the subject email tracking number ticket number #BIR-970276008717, to respond.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 27, 2022 07:39:09 AM, your request will be closed.

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. Your employer failed to file 2316 as per Compliance Section.

Your right to request a review
