I refer to my letter of Aug 18, 2022 04:08:53 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return (ITR) and/or BIR Form 2316.

In reply, kindly clarify if you have a registered business between the period 2008 to 2014, or you are under a Job Order (JO) or Contract of Service? or an Individual Earning on Purely Compensation Income (Employee) for the period 2008 to 2014?

If you are an Employee for the period 2008 to 2014, your Employer/s is/are required to issue a copy of your BIR Form 2316 for Taxable Year 2008 to 2014 pursuant to Section 2.83 of Revenue Regulations No. 02-98, as amended which provides that “The employer shall furnish each employee with the original and duplicate copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This shall serve as your Income Tax Return (ITR) and can be use for your intended purpose.

Please be informed also, that per record/files of the district office/s for the aforementioned years are already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, retention period of withholding tax certificates. It will be practical and appropriate for you to refer to your employer and ask for the said copies where it actually originated.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 11, 2022 11:12:12 PM, your request will be closed.
