HI ! I would like to request a copy of BIR 2316 form for employment, since it was processed by my previous employer in Pasay City though I am living in Negros Occidental I cant get a copy from the RDO here in Bacolod City and my previous employer also cant provide. I hope I could receive it as soon as possible in my email. Thank you and God Bless.

Dear Ms. Salanap:

I refer to my letter of Jul 13, 2023 02:31:41 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR FORM No. 2316.

In reply, please be informed that your request for a copies of your Income Tax Return and/or BIR Form No. 2316 can be obtained through your EMPLOYER as they are obligated to furnish every employee a copy of the aforesaid form as a proof of taxes withheld which shall serve as an Annual Income Tax Return (AITR) of the employee according to Revenue Regulation 2-98, as amended

The employer shall prepare BIR Form No. 2316 in triplicate, which shall be distributed as follows:

(1)	Original – Employee’s copy;
(2)	Duplicate – BIR’s copy; and
(3)	Triplicate- Employer’s copy which shall be retained for a period of ten (10) years.”

Please coordinate with your employers and ask for the copy of your BIR Form 2316 from the Calendar Years 2019 to 2022 if you have not receive a copy.

Please be informed also that the available records of BIR Form No. 2316 from our Revenue District Offices (RDOs) is from Calendar Year 2020 to 2022.

Kindly provide the following information:

1. Complete Name of your Employers (from CY 2020 to 2022);
2. Employer/s Taxpayer Identification Number (TIN);
3. Employer/s Registered Business Address,  email the requested information at sherry.ann.arcita@bir.gov.ph and indicate in the subject email ticket number #BIR-988426132161, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 05, 2023 06:33:51 AM, your request will be closed.
