I refer to my letter of Sep 03, 2022 10:55:06 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as a Substitute Income Tax Return for Taxable Year/s 2012 to 2017, Please be informed that per record/files of the Revenue District Office/s (RDOs) for the aforementioned years were already sent to Archive for Storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, Retention Period of Withholding Tax Certificates. It will be practical and appropriate for you to refer to your employer/s and ask for the said copies where it actually originated.

Kindly send us the Name of your Employer/s for the taxable period of 2018 to 2021, Employer/s Business Address and Employer/s TIN for us to coordinate and possibly endorse your request to the Revenue District Office (RDO) that has jurisdiction and where your employer/s are registered.

Email the needed information at sherry.ann.arcita@bir.gov.ph as this contains sensitive information and indicate in the subject email tracking number #BIR-036872402667, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 25, 2022 11:09:58 PM, your request will be closed.

You asked for BIR Form 2316.

Response to Request

Based on the reason stated below, we resolve to grant/deny your request as to the following information:   

Copy of your ITR for the year 2015.
Your requested information for the year 2015 is granted.  A copy of your BIR form 2316 was sent to you via the email address provided.

Copy of your ITR for the year 2016.
We regret to inform you that your request cannot be processed because your employer failed to submit a CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2016.

Copy of your ITR for the year 2017.
Your requested information for the year 2017 is granted.  A copy of your BIR form 2316 was sent to you via the email address provided.

Copy of your ITR for the year 2018.
We regret to inform you that your request cannot be processed because the submitted CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) by your employer for the year 2018 cannot be validated because it is unreadable.

Copy of your ITR for the year 2019.
This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2019.  

Copy of your ITR for the year 2020.
This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2020.  

Copy of your ITR for the year 2021.
We regret to inform you that your request cannot be processed because the submitted CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) by your employer for the year 2020 cannot be validated because it is unreadable. 

After careful consideration, however, since your TIN and name is included in the Alphalist of Employees by your employer for the year 2015-2021, we resolve to grant your request but only up to the compensation and withholding tax information found therein.  A certification was made on the information gathered for your purpose, a scanned copy of which was sent to you via the email address provided.
