Dear Ms. Cudia:

I refer to my letter of Aug 07, 2023 05:28:07 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return.

We would like to ask, do you have a Registered Business between the period 2023? Or were you an Individual Earning on Purely Compensation Income from the period 2023?, Not Withstanding your answer to the query, did you file an Income Tax Return for the cited period?

As an added note/reference, if you are an Employee for the period 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2023 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 31, 2023 08:31:40 AM, your request will be closed.
